LOCORIDES – TERMS & CONDITIONS

This agreement ("Terms & Conditions") outlines the rights and responsibilities of LocoRides Mobility LLP and the renter ("You" or "Customer") when using our rental services. By signing this document, you acknowledge that you have read, understood, and agreed to these terms.

1. Eligibility & User Agreement

  • The renter must be 18 years or older with a valid driving license and a government-issued ID proof.
  • The bike will only be provided after successful document verification.
  • LocoRides reserves the right to reject any booking if the provided documents are invalid or incomplete.

2. Rental Usage & Responsibilities

  • Riding Safety: You must follow all traffic laws and ensure helmet usage for yourself and any pillion rider.
  • Speed Limit: The maximum speed limit is 60 km/hr or as per local government regulations, whichever is lower.
  • No Reckless Riding: Stunt riding, racing, or any unauthorized activity is strictly prohibited.
  • Bike Condition: The vehicle must be returned in the same condition as received.
  • Unauthorized Repairs & Modifications: Customers shall not carry out or authorize any repairs, servicing, modifications, or alterations to the vehicle without written consent from LocoRides. Any unauthorized work will result in penalties, and the customer will be liable for all related expenses.
  • Fuel Policy: Fuel is not included in the rental charges. The bike must be returned with the same fuel level as at the time of pickup. Any extra fuel added will not be refunded.
  • Traffic Violations: In the event of any reported traffic violations during the rental period, LocoRides reserves the right to hold the customer's security deposit in order to process applicable fines, legal formalities, and penalty clearances.
  • Violation Negligence & Recovery: If a customer fails to acknowledge or settle any reported traffic violations, LocoRides reserves the full right to initiate a recovery process for the vehicle. In such cases:
    • The customer will first be formally requested to return the vehicle.
    • If the customer refuses or delays, LocoRides holds the authority to capture/repossess the vehicle without prior notice.
    • A vehicle recovery fee of ₹2,000 will be charged to cover operational expenses.
    • Any additional towing charges, legal costs, or penalties will also be borne by the customer.
  • Booking & Handover Preparation:
    Each vehicle undergoes a mandatory 15-minute preparation and safety check prior to handover. To ensure timely processing, customers are required to place bookings at least 30 minutes in advance. This is especially crucial during peak hours or urgent requests to avoid delays in delivery.

3. Rental Charges & Additional Fees

  • Security Deposit: A refundable security deposit may be required based on the selected bike model.
  • Extra KM Charges: If you exceed the allotted kilometers, additional charges will apply as per the selected bike model.
  • Late Drop-Off Charges:
    • After this, a Rs500 penalty + 5X the hourly rental charge will be applied.
  • Overspeeding Penalty: A penalty of Rs1000 will be charged after every third overspeeding warning.

4. Payment & Cancellation Policy

  • Payments must be made via the app/website through UPI, credit/debit card, or net banking.
  • Refunds (if applicable) will be processed within 5-7 business days to the original payment source.

Cancellation Fees:

  • More than 24 hours before the booking start time20% deduction (Min. 200 up to Rs2500), rest refunded.
  • Less than 24 hours but at least 3 hours before the booking start time50% deduction (up to Rs3000), rest refunded.
  • Within 3 hours of booking start time → Only 20% of the booking amount will be refunded.
  • In case of a no-show, the booking amount is non-refundable.

5. Bike Return & Damage Policy

  • The bike must be returned at the agreed location in good condition.
  • Any damages, missing parts, or traffic violations during the rental period will be the responsibility of the renter.
  • Lost Helmet: In case of a lost or unreturned helmet, a ₹1,000 replacement cost will be charged.
  • Lost Key: For a standard key, a replacement charge of ₹1,000 will apply. For an automatic keyless system, a replacement charge of ₹5,000 will apply.
  • Accidents & Repairs: If a bike is damaged in an accident, the renter responsible for causing the accident will bear the full repair costs. Rental charges will continue during the repair period until the vehicle is restored and available for use again.
  • Cleaning Policy: Please return the bike in a clean condition for the next user. Excess dirt or stains may result in an additional cleaning charge.

6. Legal & Liability Agreement

  • LocoRides is not liable for any accidents, injuries, traffic violations, or third-party damages that occur during the rental period.
  • In case of an accident, the renter must immediately inform LocoRides support and local authorities.
  • The renter must not sublet or allow an unauthorized person to use the bike.

7. Helmet Usage Policy (Strictly Enforced, Non-Negotiable)

  • Mandatory Helmet Usage: All riders are required to wear helmets at all times while operating the vehicle. This rule applies to both the primary customer and any pillion riders.
  • Penalty for Non-Compliance: A penalty of ₹1,000 per person will be charged for every instance where a rider is found not wearing a helmet. If multiple violations occur during the booking period, penalties will be applied for each violation, even within the same day.
  • Continuing the Booking:
    • To continue using the vehicle, the customer must:
      a) Pay all applicable penalty amounts in full, and
      b) Agree to wear a helmet for the remaining booking period.
  • Non-Compliance Actions:
    • If the customer refuses to pay the penalty, the security deposit will be forfeited in full.
    • The vehicle will be immediately recovered without any further notice.
    • If the total penalty amount exceeds the security deposit, a legal notice will be issued to recover the outstanding balance, along with applicable recovery charges and administrative costs.
  • Policy Enforcement:
    • This policy is strictly non-negotiable and will be enforced without exception.
    • All customers agree to this policy upon accepting the terms and renting a vehicle.

8. Governing Law & Jurisdiction

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
  • Any disputes arising out of or related to this agreement shall be subject to the exclusive jurisdiction of the courts located in Thiruvananthapuram, Kerala.
